1. Agreement to Terms

Welcome to QuexBook Studies. These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and educational services (collectively, the "Platform"). By creating an account or using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Platform. If you are using the Platform on behalf of an organization (such as a school), you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

QuexBook Studies is an AI-powered learning management system designed for Filipino Senior High School students and educators. Our services include:

• Access to curriculum-aligned lectures and study materials
• Interactive quizzes and assessments
• QuBo AI study assistant powered by artificial intelligence
• Progress tracking and gamification features (XP, levels)
• Flashcard creation and study tools
• Class management for educators
• Note-taking and file upload capabilities

3. User Accounts

3.1 Account Registration

To access most features, you must create an account by providing accurate and complete information. You may register as a Student or Educator. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Eligibility

Our Platform is designed for Senior High School students (typically ages 16-18) and educators. Users under 18 should have parental awareness of their use of the Platform. Users under 13 are not permitted to create accounts.

3.3 Account Security

You agree to notify us immediately of any unauthorized access to your account. We are not liable for any loss or damage arising from your failure to protect your account credentials. Device session limits apply: Free accounts are limited to 1 active device; Premium accounts allow up to 3 active devices.

3.4 Account Termination

You may delete your account at any time through your account settings. We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for extended periods.

4. Subscriptions and Payments

4.1 Free and Premium Plans

QuexBook Studies offers both free and premium subscription plans:

• Free Plan: Limited access to features including daily AI usage limits
• Premium Monthly: ₱199/month - Full access to all features
• Premium Quarterly: ₱480/3 months (₱160/month) - 20% savings
• Premium Yearly: ₱1,548/year (₱129/month) - 35% savings

4.2 Payment Processing

Payments are processed through Xendit, our third-party payment provider. We accept GCash, Maya, credit/debit cards, and bank transfers. By making a purchase, you agree to Xendit's terms of service and authorize us to charge your selected payment method.

4.3 Billing and Renewals

Subscriptions are billed at the beginning of each billing period. Your subscription will not automatically renew. You will receive notifications before your subscription expires (7 days, 3 days, and 1 day prior) to remind you to renew if desired.

4.4 Refund Policy

Due to the digital nature of our services, we generally do not offer refunds once a subscription period has begun. However, we may consider refund requests on a case-by-case basis for technical issues that prevent service access. Contact support@quexbook.com for assistance.

4.5 Price Changes

We reserve the right to modify subscription prices. Existing subscribers will be notified of any price changes at least 30 days before their next billing cycle. Price changes will not affect active subscription periods.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use the Platform to:

• Access educational content for personal learning
• Take quizzes and track your academic progress
• Interact with QuBo AI for study assistance
• Create and manage flashcards and notes
• Participate in classes (as a student or educator)

5.2 Prohibited Conduct

You agree NOT to:

• Share your account credentials with others
• Use the Platform for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Distribute, copy, or sell our educational content without permission
• Use automated tools to scrape or extract data from the Platform
• Upload malicious content, viruses, or harmful code
• Harass, bully, or harm other users
• Impersonate others or provide false information
• Use QuBo AI to generate harmful, illegal, or inappropriate content
• Attempt to manipulate quiz scores or XP through dishonest means
• Circumvent subscription restrictions or payment requirements
• Use the Platform in ways that violate Philippine laws or regulations

5.3 Academic Integrity

QuexBook Studies is designed to support genuine learning. Using the Platform to cheat on external examinations, plagiarize content, or engage in academic dishonesty is strictly prohibited. We encourage honest engagement with all learning materials and assessments.

6. User Content

6.1 Your Content

You retain ownership of content you create or upload, including notes, flashcards, and uploaded files. By uploading content, you grant us a non-exclusive license to store, display, and process your content as necessary to provide our services.

6.2 Content Responsibility

You are solely responsible for content you upload or create. Do not upload content that infringes on intellectual property rights, contains personal information of others without consent, or violates any laws.

6.3 Content Removal

We reserve the right to remove any user content that violates these Terms or that we deem inappropriate, without prior notice.

7. Intellectual Property

7.1 Our Content

All content provided by QuexBook Studies, including but not limited to lectures, quizzes, graphics, logos, design elements, and software, is owned by us or our licensors and is protected by copyright and other intellectual property laws. You may not copy, distribute, or create derivative works without our written permission.

7.2 Trademarks

"QuexBook Studies," "QuBo," and associated logos are trademarks of QuexBook Studies. You may not use our trademarks without prior written consent.

7.3 Feedback

If you provide feedback, suggestions, or ideas about our Platform, you grant us the right to use such feedback without compensation or attribution.

8. AI Services (QuBo)

8.1 AI Limitations

QuBo is an AI-powered study assistant designed to help with learning. While we strive for accuracy, AI-generated responses may occasionally contain errors or inaccuracies. QuBo should be used as a supplementary learning tool, not as a sole source of information. Always verify important information with official educational materials or qualified educators.

8.2 AI Usage Limits

AI features are subject to usage limits:

• Free users: 3 AI summaries/flashcards per day, 10 QuBo messages per day
• Premium users: 100 AI summaries/flashcards per month, 500 QuBo messages per month

8.3 AI Content Policy

Do not use QuBo to generate content that is harmful, illegal, discriminatory, or inappropriate. We monitor AI usage to ensure compliance and may restrict access for violations.

9. Educator-Specific Terms

9.1 Educator Accounts

Educators may create classes and invite students to join. Educators are responsible for managing their classes and ensuring appropriate use by their students.

9.2 Student Data Access

Educators may view progress and performance data for students enrolled in their classes. Educators agree to use this data solely for educational purposes and to protect student privacy.

9.3 Educator Responsibilities

Educators agree to use the Platform in accordance with their school's policies, professional ethics, and applicable laws governing education in the Philippines.

10. Disclaimers

10.1 Service Availability

We strive to maintain Platform availability but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, or technical issues.

10.2 Educational Outcomes

While our Platform is designed to support learning, we do not guarantee specific educational outcomes, grades, or examination results. Success depends on individual effort and engagement.

10.3 "As Is" Provision

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUEXBOOK STUDIES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

Our total liability for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless QuexBook Studies and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

13. Governing Law and Disputes

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI).

13.3 Jurisdiction

For any matters not subject to arbitration, you agree to submit to the exclusive jurisdiction of the courts located in Metro Manila, Philippines.

14. Modifications to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. For material changes, we may also send an email notification. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and QuexBook Studies regarding your use of the Platform and supersede any prior agreements or understandings.
